What music is copyrighted?

A music is copyrighted when an authors own the exclusive rights to their compositions or work. This is called a copyright, and the composition is protected for many years( up to 70 years) --even if the copyright is never registered with the copyright office. A composition is considered to be "intellectual property" The copyright may be sold, transferred, or inherited--but the copyright still endures. If any music or lyrics are still under copyright protection
  • you CANNOT reproduce the music or lyrics
  • you CANNOT give out the music or lyrics either for free, for no profit, or for profit
  • you CANNOT perform the music/song or lyrics in public
  • you CANNOT listen to a recording of the music or lyrics in public--even if you own the CD

How does a song get copyrighted?

1. Send a request for a form SR or PA application to the Copyright Office, Library of Congress, 101 Independence Avenue, S E., Washington, D.C. 20559-6000 or download the application from the website: www.copyright.gov Note: To order an application by telephone, call (202) 707-9100. 2. When the application is completed (properly), send it back to the Copyright Office with: (a) If your work is not unpublished yet - you send one copy of manuscript, lead sheet OR sound recording of the best edition…or (b) If you had published it- send two copies of manuscript (sheet music) OR a sound recording of the best edition…and (c) The appropriate non-refundable registration fee, which is presently $45, by money order, bank draft or check, made payable to Register of Copyrights. (see current fees)3.Now, wait for application to process. You should get your certificate back in the mail. It will take about (about 5 to 6 months), but your song is actually registered as soon as the Copyright Office gets your package (if everything is correct in the package; the application, and the fee).

How is this impacting the music industry

By people downloading music for free the music industry losses money because they don't make money because people aren't paying for it, so they don't make as much money as they payed for it.
